Instead, each Host authorizes us to act as their commercial agent and negotiate and conclude each storage agreement on their behalf. The Host\u2019s personal information and geographical address will be provided in the booking information and the storage agreement.<\/span><\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\"><span style=\"margin: 0px; padding: 0px; outline: none;\" data-slate-fragment=\"JTVCJTdCJTIydHlwZSUyMiUzQSUyMnBhcmFncmFwaCUyMiUyQyUyMmNoaWxkcmVuJTIyJTNBJTVCJTdCJTIydGV4dCUyMiUzQSUyMjIuJTIwQm9va2luZ3MlMjBhbmQlMjBGZWVzJTIwUGF5YWJsZSUyMHRvJTIwSG9zdHMlMjIlN0QlNUQlN0QlNUQ=\">2. Bookings and Fees Payable to Hosts<\/span><\/h2><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.1\u00a0<span style=\"margin: 0px; padding: 0px; outline: none;\" data-slate-node=\"text\">Customers may book storage through the Website or the apps at any time. To confirm your booking, please check the Host\u2019s opening hours prior to booking. To book storage through the Website or Apps, please register to create a data account.<\/span><\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.2 Each Customer agrees to provide accurate, current, and complete information during the registration process and to update that information as necessary to keep it accurate, current and complete. Fenua Lockers reserves the right to suspend or terminate your Fenua Lockers Customer Account and access to the Website if any information provided to us by you proves to be inaccurate or incomplete. You are responsible for safeguarding your password and agree that you will not disclose your password to any third party. You must immediately notify Fenua Lockers of any unauthorized Fenua Lockers Customer Account by emailing\u00a0<a style=\"margin: 0px; padding: 0px; color: #eded00; transition-property: all;\" href=\"mailto:info@fenualockers.com\" target=\"_blank\" rel=\"noopener noreferrer\">info@fenualockers.com<\/a>. You shall be solely responsible and liable for use of your Fenua Lockers Customer Account, whether or not you have authorized those actions unless they occur after you have notified us of any unauthorized use.\u00a0<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.3 When placing a Booking, each Customer will be asked to provide certain information, such as i) dates and approximate times for dropping off and picking up items, ii) a number of items, and iii) any relevant notes to the order. In addition, each Customer will be asked to provide customary billing information, such as name, billing address, and contact details. Each customer will also be asked to provide the payment card information to a third-party payment provider and each Customer\u2019s payment card will be debited at the time of booking. Once payment is confirmed, a Customer\u2019s Booking transaction and payment are complete, and the Customer will receive an e-mail confirmation summarising his confirmed Booking. All payments by Customers to Fenua Lockers and by Fenua Lockers to Hosts will be processed through the Stripe online payment system unless clearly stated otherwise. Payments made through Stripe will be subject to their automatic fraud checks. Please see www.stripe.com\/radar for more information.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.4 Customers are reminded that\u00a0<span style=\"margin: 0px; padding: 0px; outline: none; font-weight: bold;\">Storage must be booked through the Website or Apps<\/span>. Hosts are not permitted to accept cash payment in stores and Customers must not attempt to pay for Storage in cash or otherwise outside the Website or Apps. Doing so breaches these terms and conditions and as a result, invalidates the insurance that the Customer would otherwise benefit from, see Condition 6 \u201c<em style=\"margin: 0px; padding: 0px; outline: none;\">Insurance<\/em>\u201d below.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.5 The fees for each transaction are displayed in the pricing section of the Website or Apps and are stated inclusive of VAT. Fees are charged on a time of Storage basis, so if a Customer fails to comply with his stated Storage and collection times, additional charges may be debited to his payment card.<\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">3. Storage Agreement with the Host<\/span><\/h2><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.1 Hosts are responsible for:<\/p><ul style=\"margin-right: 0px; margin-bottom: 20px; margin-left: 0px; padding: 0px 0px 0px 30px; outline: none; list-style-position: inside; font-size: 14px;\"><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">restricting access to the storage area when bags are kept in storage<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">supervising access to the storage area when bags are dropped off or collected<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">looking after the bags in their care<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">locking bags away<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Verifying a customer\u2019s photo ID against the name on the booking confirmation<\/span><\/li><\/ul><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.2 The Website or Apps provide the opening times of each Host, and you are responsible for checking that these suit your Booking plans. By making a booking and paying for Storage through the Website or Apps, you enter into a contract with the Host who provides that Storage on the standard terms and conditions displayed to you during the booking process (and available\u00a0<a style=\"margin: 0px; padding: 0px; color: #eded00; transition-property: all;\" href=\"https:\/\/fenualockers.com\/fr\/terms-and-conditions\/\">here<\/a>) which also form part of these Conditions (<span style=\"margin: 0px; padding: 0px; outline: none; font-weight: bold;\">\u201cStorage Agreement\u201d<\/span>). Fenua Lockers is not a party to the Storage Agreement.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.3 Each Customer will comply with the security arrangements specified or referred to by the Host in the Storage Agreement, including the provision of proof of Booking and proof of identity, an inspection of the luggage stored, sealing of bags and\/or photographing the luggage to record condition. Unless otherwise specifically agreed in the Storage Agreement, only the Customer who deposits an item may collect that item.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.4 Each Customer is responsible for any injury or damage to the Host, its property or any third parties caused by the items stored or by any negligent act or omission of the Customer. Each Host is responsible for any damage to, or loss or theft of, items stored with that Host unless the damage is caused by factors beyond the control of the Host.\u00a0<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.5 If a Host alters its opening hours (either generally or on a particular day) and this will affect an existing Booking by you, the Host must inform Fenua Lockers by email to info@fenualockers.com as a matter of urgency. Where a Host is not open to receive or deliver on a confirmed booking, we will refund the Storage Fee paid by you and\/or, where practicable and with your consent, to arrange a Booking and Storage Agreement with an alternative Host. In the case that you cannot access your bags at your pickup time, Fenua Lockers will attempt to make reasonable arrangements to get your bag to you. For this reason, you must not store valuables or travel documents.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.6 If you fail to collect your luggage at the time stated in the Storage Agreement, the Host must inform us. We will attempt to reach you and arrange for you to collect your luggage at a new time. Failing this, we will arrange for the collection of your luggage from the Host and delivery of your luggage to you, at your expense. If we are unable to contact you, or you fail to arrange collection and delivery, we will arrange to collect your luggage and dispose of it without further responsibility or liability to you or the Host.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.7 The host may have to close due to unforeseen circumstances. In the event that a host is closed during the opening hours listed on fenualockers.com<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">\u00a0<\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">4. Prohibited Items<\/span><\/h2><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-weight: bold;\">YOU AGREE THAT YOU WILL NOT STORE OR MAKE A BOOKING TO STORE ANY OF THE FOLLOWING ITEMS:<\/span><\/p><ul style=\"margin-right: 0px; margin-bottom: 20px; margin-left: 0px; padding: 0px 0px 0px 30px; outline: none; list-style-position: inside; font-size: 14px;\"><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Valuable electronics (phones, laptops)<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Travel documents (passports)<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Explosives, fuel, hazardous or flammable materials<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Pesticides, toxic chemicals, pollutants, waste of any kind<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Firearms, ammunition, illegal drugs or other controlled substances<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Stolen goods, illegal or unlawful substance(s) or other contraband<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Perishable food items, spoiled food, living or diseased plants or animals, infested or otherwise contaminated items, damp or moldy items<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Radioactive materials, items that emit fumes or other strong odors<\/span><\/li><li style=\"margin: 0px; padding: 0px; outline: none; line-height: 24px; letter-spacing: 0px; font-family: Quicksand, sans-serif;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">Cash, fine art and securities (e.g. share certificates)<\/span><\/li><\/ul><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">The Host may remove and dispose of any item stored that breaches this Condition without notice to the Customer and without any responsibility to the Customer. The Host may also report to any relevant authority any illegal or suspected illegal activities of the Customer or any hazardous item stored.\u00a0<\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">5. Cancellations and Refunds<\/span><\/h2><p style=\"margin-bottom: 20px; padding: 0px; outline: none;\"><span style=\"font-size: 14px; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">5.1 The Storage Seeker may cancel their reservation and receive a full refund if the cancellation is made within 72 hours (3 days) from the payment day.<\/span><\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none;\"><span style=\"font-size: 14px; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">5.2 The Company allows the Storage Seeker to cancel their reservation through the following channels only:<\/span><\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none;\"><span style=\"font-size: 14px; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">5.2.1 Signing in and canceling the reservation within 72 hours (3 days) from the payment day.<\/span><\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none;\"><span style=\"font-size: 14px; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">5.2.2 Emailing info@fenualockers.com.<\/span><\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none;\"><span style=\"font-size: 14px; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">5.2.3 Starting a chat on the Website.<\/span><\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none;\"><span style=\"font-size: 14px; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">5.3 To cancel reservations within 72 hours (3 days) from the payment day, the Storage Seeker must use either method described in 5.2.2 or 5.2.3.<\/span><\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none;\"><span style=\"font-size: 14px; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">5.4 Any requests for cancellation and refund that do not comply with sections 5.2 would not be considered.<\/span><\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none;\"><span style=\"font-size: 14px; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">5.5 The Host will not provide the Storage within the Cancellation Period unless expressly requested by the Customer. The Storage shall be considered fully performed when the stored items are placed in the storage space, at which point the Customer ceases to have the right to cancel the Storage Agreement.<\/span><\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none;\"><span style=\"font-size: 14px; color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">5.6 If a Host is unable to fulfill a Booking, the Fenua Lockers team will notify the Customer and provide a refund or, if the Customer requests, arrange storage with an alternative Host in accordance with these Conditions (and the new Storage Agreement between the Customer and the alternative Host)<\/span><\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">6. Fenua Lockers Guarantee<\/span><\/h2><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.1 The Company guarantees to pay an amount up to $1,000 in compensation for loss or damage to your property, subject to the limitations, exclusions, and conditions contained in this clause 6. You should carefully read all of these clauses before participating in a booking to ensure that you do not do anything which will invalidate the Guarantee.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.2 You acknowledge and agree that in all cases, the Company will decide in its sole discretion whether any claim made pursuant to this clause meets the conditions imposed by this clause, and what exclusions and limitations apply, and the Company\u2019s decision on such matters will be final and binding. You further acknowledge and agree that:<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.2.1 We reserve the right to withdraw the guarantee at any time before a claim is made, and following withdrawal no new claims will be considered;<br style=\"margin: 0px; padding: 0px; outline: none;\" \/><\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.2.2 The Guarantee is intended to promote the use of our services by encouraging users to formalize their booking arrangements. The Guarantee is a guarantee of\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">responsibility between users and is not an offer to insure your property and does not constitute a contract of insurance.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3 In order to be eligible for consideration for a Guarantee payment, you must be compliant with the following conditions at all material times. If in the Company\u2019s reasonable opinion, you are not fully compliant with each requirement in this clause, or if you cease to be so compliant at any time during the process of invoking the Guarantee (for example by receiving an insurance payment), the Guarantee will be invalid and no payment will be made to you. If you do not wish or are unable to comply with any of these conditions, you should inform us and the Guarantee will not apply to you:<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\">\u00a0<\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3.1 You must (a) have suffered loss or damage to property during the period of validity of a booking; (b) be 18 or over and a registered user of the Website; (c) be a\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">participant as a seeker or provider (referred to as \u2018party\u2019 or \u2018parties\u2019\u2122) of the booking giving rise to the claim; (d) make all bookings only using the online booking system\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">on the Website; (e) not have committed a material breach of any of these Terms and Conditions, and (f) if you are the Provider, be a policyholder for a valid contents\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">insurance policy covering the Storage Address and Storage Space against accidental damage and theft.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3.2 You must be either (a) in the case of Storage Provider, the owner or mortgagee or contracting tenant of the storage space address, or (b) in the case of Storage<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">Seeker, the owner of all the goods in respect of which the Guarantee is to be invoked<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3.3 You must have used your best efforts to resolve the situation and recover your losses by (a) initially, with the other party by mutual agreement as to liability and\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">appropriate compensation with reference to the booking; (b) where theft or criminal damage or illegal activity of any nature is suspected or alleged, by contacting the\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">police and, following the outcome of any criminal investigation, making any claim for compensation to any insurer or other body (including without limitation government=<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">bodies or schemes) which is or becomes available following such investigation; and (c) by making a claim or claims to any and all existing insurers (including without\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">limitation household insurers) and pursuing them to their official conclusion.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3.4 You must not have received any payment of any amount whatsoever from any insurer or the other party or any other third party in respect of the loss for which you are claiming.<br style=\"margin: 0px; padding: 0px; outline: none;\" \/><\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3.5 You must not make any claims under this clause for (a) a second time after the original claim was rejected by the Company, or (b) after 1 week from the date when the loss or damage occurred.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3.6 You must be prepared to (a) disclose relevant communications from your insurance company to us (to the extent that you are permitted to do so under any\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">confidentiality obligations) including without limitation correspondence regarding any claims you make against any insurance policy in respect of the loss or damage;\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">claimed for; and (b) at the Company\u2019s discretion, to submit a Data Access Request at your own cost to fraud prevention agencies or insurance information\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">exchanges\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">and to disclose all information received to us except where we agree that any part of such information is not relevant.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3.7 The Company must not have any reason to suspect you of dishonesty. For the avoidance of doubt, the Guarantee will not apply and your User status suspended\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">where the Company discovers or reasonably suspects based on information received from any relevant, reputable source (including without limitation the police or any\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">government or regulatory body) (a) that you are intending or attempting to abuse the Guarantee; (b) that you have been involved in any fraudulent or illegitimate activity\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">related to false insurance claims or similar dishonesty; or (c) that any loss or damage which would otherwise be covered by the Guarantee was the result of any illegal or\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">dishonest act or omission by you.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3.8 You must cooperate fully with all investigations and requests made by the Company in carrying out its investigations and obligations under this clause.<\/span><\/div><\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\">\u00a0<\/div><div style=\"margin: 0px; padding: 0px; outline: none; font-size: 14px;\"><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.3.8 You must cooperate fully with all investigations and requests made by the Company in carrying out its investigations and obligations under this clause.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.4 Financial limits of the Guarantee. Subject to the limitations, exclusions, and conditions contained in this clause 6, the Company will pay up to a maximum of $5,000 per claim to repair or replace (at our discretion) your property damaged or destroyed as a result of a Qualifying Loss. Replacement items will be valued at their actual cash value, that is their current market value minus wear and tear. The sentimental value of items shall not be relevant to their valuation.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.5 Process of invoking the Guarantee. Failure to comply with the deadlines in this clause will invalidate the Guarantee. You must notify the Company using the email address listed below or on the contact us page within seven days of discovering the loss or damage for which you wish to invoke the guarantee. You must cooperate in supplying all evidence of your identity, address, and loss or damage suffered as we reasonably require. Where criminal damage, theft, or other criminal or illegal activity is suspected, you must have notified the police within 48 hours of discovery and before you notify us, and when you notify the Company you must provide a crime reference number or its equivalent in your jurisdiction. We will contact you within three working days to advise whether your claim is eligible for consideration, giving you one of three responses:<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.5.1 \u2018Claim Invalid\u2019, meaning that your claim is not covered by the Guarantee for the reason(s) stated;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.5.2 \u2018Claim Pending\u2019, meaning that your claim is on hold until the steps outlined in the response are taken and pursued to a conclusion. This will normally mean that\u00c2 \u00c2 the outcome of a claim against insurance or a criminal investigation is awaited. It is your responsibility to maintain contact with the police and\/or insurance company\u00c2 and\/or any other agent or applicable entity to follow the process of the investigation, criminal proceedings, or claim; or<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.5.3 \u2018Claim Eligible\u2019\u009d, meaning that we are prepared to consider your claim and you have 10 days from receipt of our response to follow the steps in clause 8.6.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.6 If our response to the process described in clause 6.5 is that you have an Eligible Claim, you must submit a full claim within 10 days of that response. A full claim must include:<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.6.1 A statement signed by you confirming that the information in the claim is true to the best of your knowledge and belief;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.6.2 A complete description of the loss or damage suffered, including dates (which may be estimated where exact dates are impossible to confirm), nature and cause thereof, and including proof of ownership, date of acquisition, physical condition, and supporting evidence such as receipts, inventories, quotes for repair work,\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">etc\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">plus the\u00a0 claimed value of any high-value items lost or damaged;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.6.3 Where you are the Storage Provider, evidence of your ownership or tenant status with regard to the premises;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.6.4 A statement giving full details and dates of what, if any, action you have taken to resolve the matter, including without limitation negotiations with the other party\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">to\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">the booking, claims against insurance policies and police reports, and all communications with the foregoing, including responses received;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.6.5 A declaration as to whether any insurance policy or security deposit or other potential avenues of recovery applies. If an existing insurance policy or other mechanism exists but does not apply, the reasons must be given. If they do apply, the evidence must be supplied that the process of claiming has been initiated and the claim to the Company may then be put on hold until such process is concluded.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7 Upon receipt of a full claim, the Company will evaluate it before making a decision as to whether to make a payment under the Guarantee. Except in exceptional circumstances or those beyond its control, the Company will make a decision within 90 days of receipt of the full claim. As part of its evaluation of the full claim, the Company may do any of the following, in its sole discretion:<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7.1 Require you to submit a Data Access Request at your own cost to fraud prevention agencies or insurance information exchanges and to disclose the results to us;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7.2 Require the parties to the booking to participate fully in independent mediation, and you hereby agree to do this in the event that a full claim is made under any\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">booking with respect to which you are a party to the booking.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7.3 Obtain a valuation of any item or items claimed for from an independent expert;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7.4 Obtain a loss assessment from an independent expert where we believe it to be necessary. Such experts may include without limitation lawyers, surveyors\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">and\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">pest controllers.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7.5 Require you to obtain up to three quotes for repair work;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7.6 Make requests for further information from the other party, insurance companies, the police or other authority (including local authorities), or other relevant parties<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">(such as neighbors or witnesses to any incident out of which the claim arises). As a party to a booking, you hereby agree to use your best efforts to facilitate such\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">investigations, including giving your permission for information to be released to us where we reasonably require this and including where the person making the\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">full\u00c2\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">claim is the other party with respect to which you have made the booking;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7.7 Conduct interview(s), either ourselves or via a representative, with either party or with any relevant third party, and you hereby agree to use your best efforts to facilitate<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0such activity;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7.8 Inspect (either ourselves or using an expert to carry out the inspection on our behalf) any damaged items or any remaining Stored Items or the Storage Space or storage<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0Premises upon reasonable notice; and\/or<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.7.9 Pay a sum under the Guarantee or refuse to do so, giving reasons for the decision.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8 Exclusions. The Guarantee does not cover or apply to:<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.1 Any booking with respect to which the Company has not received a list of items signed by the party requesting such a claim in which all items are individually\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">listed\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">along with their estimated value;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.2 Any loss or damage not reported in accordance with clause 6.5;<br style=\"margin: 0px; padding: 0px; outline: none;\" \/><\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.3 Any loss or damage in excess of any limitations set out in clause 6<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">.4 arising out of one or more bookings entered into by the claimant;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.4 Items damaged in transition. The phrase \u2018damaged in transition\u2019 includes without limitation damage occurring while (a) transporting items to and from the storage\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">space, (b) storing, packing, and organizing a storage space at any time during the period for which the booking is valid;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.5 Damage to stored items, or to the premises by stored items, which were not packed reasonably safely and securely, or which were stored in a way that made it reasonably foreseeable that damage to the items or the premises could occur. By way of example, but not limited to, none of the following would be covered: fragile glass items in cardboard boxes with weighty boxes placed on top of them, unprotected photos stored in a damp environment, or items made of cloth packed in an unsealed bag, or liquids stored without being properly sealed, heavy items placed in areas unable to bear their weight, or items that rust due to a damp environment;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.6 Damage caused by reasonably foreseeable and preventable occurrences (including without limitation fire or burst water pipes) where either party failed to take\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">reasonable measures to prevent or limit such damage. By way of example, but not limited to, failing to repair faults in the structure or fittings at the premises or failing\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">to f<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">it\u00a0 smoke alarms at the premises;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.7 Damage to stored items or to the premises by a third party (including without limitation outside contractors engaged by either party, other Storage Seekers who are party to another booking with the Storage Provider, or other adults or children residing at or visiting the storage address);<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.8 Single items valued at less than (although such items may constitute part of a collective claim for lower-value items);<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.9 Currency, money, precious metal in bullion form, notes or securities; jewelry; works of art or antiques valued at or above documents which would be costly or\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">difficult to replace, including without limitation passports or original versions of business contracts, deeds, and certifications or qualification;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.10 Theft of or damage to any item in respect of which the Storage Seeker cannot provide at least one of the following to the Company\u2019s reasonable satisfaction: (a)<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">proof of purchase of that item; (b) a photograph\/email\/video actually sent or received of the item and dated on or before the date of the booking, or (c) any\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">other\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">evidence\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">which demonstrates proof of ownership and\/or value;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.11 Theft or malicious or criminal damage to items (a) which is not reported to the police within 48 hours of an innocent party becoming aware of it, and in any event within<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a07 days of the end of the booking period, or (b) where efforts to recover the value thereof (whether via criminal compensation schemes or from existing insurance\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">policies) have been unsuccessful;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.12 Any loss or damage (a) to or caused by Prohibited Item(s) knowingly stored, or (b) to any items or property claimed in respect of any booking where Prohibited Item(s) were knowingly stored. For the avoidance of doubt, the presence of Prohibited Item(s) will automatically preclude any claim by the Storage Seeker against the Guarantee, and may preclude any such claim by the Storage Provider where the Company reasonably suspects that the Storage Provider was aware of such presence, regardless of whether the claimed loss or damage was caused by or related to the presence of such Prohibited Item(s);<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.13 Damage caused by stored items to goods or personal possessions owned by the Storage Provider. The Guarantee only covers damage to the fixtures, fittings or structure of the premises;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.14 Damage caused by or attributable to ordinary wear and tear;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.15 Any injury to or illness or death of any person arising out of the booking, or any claim based on the occupier\u2019s liability of the Storage Provider. Such events\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">must\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">be claimed for and\/or litigated out with the Guarantee scheme;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.16 Any loss or damage caused directly or indirectly by an event of Force Majeure. These include without limitation earthquake, storm, adverse weather conditions or natural physical disasters, power failures, epidemics, labor disputes, riot or civil disorder, war, acts of terrorism, or acts of God;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.17 Any loss or damage suffered as a result of the theft or misuse of personal data or identity;<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.18 Non-payment of any part of the Price or any other monies owed by the Storage Seeker to the Company.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.8.19 Indirect losses of any kind, including without limitation loss of profit, goodwill, or business.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.9 Modifications and Cancellation of the Guarantee. The Company reserves the right to modify or cancel the Guarantee at any time and at its discretion.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.9.1 In the event of cancellation, no new claims will be permitted, but any claims under the Guarantee which are already in process (that is, the email request been\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">sent\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">us) will be considered in accordance with the version of this clause 8 in effect at the time of submission of the email request.<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">\u00a0<\/span><\/div><div style=\"margin: 0px; padding: 0px; outline: none;\"><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">6.9.2 Where the Company modifies the Guarantee, we will display a notification on the Site and your continued use of the Website or services will indicate\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">your\u00a0<\/span><span style=\"margin: 0px; padding: 0px; outline: none; font-family: 'Helvetica Neue';\">acceptance of the modification.<\/span><\/div><\/div><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\"><span style=\"margin: 0px; padding: 0px; outline: none;\">7. Fenua Lockers n\u2019agit pas lui-m\u00eame en tant qu\u2019h\u00f4te.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">1.3 En tant qu\u2019h\u00f4te, vous nous autorisez par les pr\u00e9sentes \u00e0 agir en tant qu\u2019agent commercial pour n\u00e9gocier et conclure un Contrat de Stockage avec chaque Client en vertu de l\u2019article 3 des Conditions Clients, uniquement pour votre compte, pour la prestation de Stockage que vous leur proposez. En cette qualit\u00e9 limit\u00e9e, nous ne sommes pas partie au Contrat de Stockage. Votre adresse g\u00e9ographique et votre identit\u00e9 en tant qu\u2019H\u00f4te seront pr\u00e9cis\u00e9es dans la r\u00e9servation correspondante avec chaque Client pour la prestation de Stockage (\u201d R\u00e9servation \u201c) et dans le Contrat de Stockage. Vous acceptez que nous puissions d\u00e9duire des Frais de Stockage pay\u00e9s par les Clients le montant de la Commission que vous nous devez pour vous avoir fourni notre Service. L\u2019obligation de chaque client de payer les frais de stockage est satisfaite lorsque nous prenons en charge le paiement des frais de stockage en tant que \u201d commer\u00e7ant officiel \u201c, ce qui appara\u00eet sur le relev\u00e9 de carte ou de compte de paiement du client. Annonces<\/h2><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.1 Fenua Lockers cr\u00e9e une annonce pour chaque h\u00f4te en utilisant les informations fournies par cet h\u00f4te (\u201cAnnonce\u201d). Pour figurer sur ce site Web ou l\u2019application, l\u2019espace \u00e0 utiliser pour le stockage (\u201cespace de stockage\u201d) doit avoir une adresse physique valide.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.2 Chaque H\u00f4te d\u00e9clare et garantit que son annonce et la R\u00e9servation ou l\u2019utilisation par un Client de son Espace de Stockage : (i) ne violera pas les accords qu\u2019il a conclus avec des tiers ; (ii) sera conforme \u00e0 toutes les lois et r\u00e9glementations (y compris les lois et r\u00e9glementations fiscales) qui peuvent s\u2019appliquer \u00e0 l\u2019H\u00f4te ; et (iii) n\u2019entrera pas en conflit avec les droits de tiers. Fenua Lockers n\u2019assume aucune responsabilit\u00e9 quant au respect par un h\u00f4te des lois et r\u00e8glements applicables. Il incombe \u00e0 l\u2019h\u00f4te de s\u2019assurer de la l\u00e9galit\u00e9 de la prestation de services de stockage aux clients conform\u00e9ment aux dispositions d\u2019un contrat de stockage.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.3 Chaque Contrat de Stockage est conclu par chaque H\u00f4te lorsqu\u2019un Client r\u00e9serve et paie un Stockage via le Site Internet ou l\u2019application mobile conform\u00e9ment \u00e0 l\u2019article 3 des Conditions Clients. Fenua Lockers n\u2019est pas partie au Contrat de Stockage.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.4 L\u2019H\u00f4te doit restituer au Client les articles stock\u00e9s dans le m\u00eame \u00e9tat que celui dans lequel ils ont \u00e9t\u00e9 stock\u00e9s au moment et \u00e0 la date indiqu\u00e9s dans la r\u00e9servation.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.5 Chaque h\u00f4te doit s\u2019assurer que son annonce ne viole ni n\u2019invalide aucun contrat ou politique applicable en mati\u00e8re d\u2019hypoth\u00e8que, d\u2019assurance ou autre. Chaque h\u00f4te doit v\u00e9rifier les termes d\u2019un tel accord ou d\u2019une telle politique avant d\u2019annoncer la disponibilit\u00e9 de son stockage. Chaque h\u00f4te doit \u00e9galement \u00eatre l\u00e9galement autoris\u00e9 \u00e0 faire de la publicit\u00e9 pour le stockage sur le site web ou l\u2019application mobile.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.6 Fenua Lockers est responsable de l\u2019assistance aux clients et tous les h\u00f4tes sont encourag\u00e9s \u00e0 adresser les demandes des clients \u00e0 Fenua Lockers, si l\u2019h\u00f4te n\u2019est pas en mesure de traiter directement la demande du client.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">2.7 Fenua Lockers peut offrir aux h\u00f4tes la possibilit\u00e9 de publier leurs propres annonces pour des services suppl\u00e9mentaires selon les conditions et les tarifs standard de Fenua Lockers en vigueur pour les espaces publicitaires.\u00a0<\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\">3. Obligations G\u00e9n\u00e9rales<\/h2><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.1 Chaque H\u00f4te reconna\u00eet et accepte que : (i) il est responsable de toutes les informations figurant dans son Annonce sur le Site Web ou l\u2019application mobile, y compris la notification \u00e0 Fenua Lockers en cas de modification de ses heures d\u2019ouverture ou de toute autre information pertinente ; (ii) il est tenu de fournir des informations de compte bancaire correctes afin de recevoir le paiement des Frais de stockage de la part de Fenua Lockers et qu\u2019il notifiera rapidement Fenua Lockers en cas de modification des informations de compte fournies ; (iii) il ne participera \u00e0 aucun service, site Web ou application de tiers offrant le m\u00eame service ou un service substantiellement identique \u00e0 celui de Fenua Lockers, sans l\u2019approbation \u00e9crite pr\u00e9alable de Fenua Lockers, qui peut \u00eatre accord\u00e9e sous conditions ; (iv) il ne conclura aucune transaction de stockage avec une personne qui lui a \u00e9t\u00e9 pr\u00e9sent\u00e9e par Fenua Lockers autrement que par le biais de ce site Web ; (v) il n\u2019acceptera de paiement pour le stockage que sous la forme de frais de stockage qui lui seront pay\u00e9s par Fenua Lockers, nets de toute commission.\u00a0<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.2 Si un h\u00f4te enfreint la clause 3.1(iii), sans pr\u00e9judice de tout autre droit ou recours dont il peut disposer, Fenua Lockers peut (i) convenir avec l\u2019h\u00f4te d\u2019une commission r\u00e9vis\u00e9e \u00e0 un niveau inf\u00e9rieur et\/ou (ii) exiger le remboursement de 100 000 xpf de commission pay\u00e9e ou payable par Fenua Lockers \u00e0 l\u2019h\u00f4te.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.3 Lors de la r\u00e9servation, il sera demand\u00e9 \u00e0 chaque Client de fournir certaines informations, telles que : (i) le nom, (ii) les dates et heures approximatives de d\u00e9p\u00f4t et de retrait des articles, (iii) le nombre d\u2019articles et (iv) toute note pertinente \u00e0 la commande. Ces informations seront transmises par Fenua Lockers \u00e0 l\u2019H\u00f4te selon les termes de l\u2019addendum aux pr\u00e9sentes Conditions relatif au traitement des donn\u00e9es personnelles (\u201cAddendum sur la protection des donn\u00e9es\u201d).<\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\">4. Stockage<\/h2><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">4.1 Il est de la responsabilit\u00e9 de chaque H\u00f4te de suivre la liste de contr\u00f4le de s\u00e9curit\u00e9 \u00e9tablie dans l\u2019Annexe aux pr\u00e9sentes Conditions, telle que modifi\u00e9e par Fenua Lockers de temps \u00e0 autre (\u201d Liste de contr\u00f4le de s\u00e9curit\u00e9 \u201c) lorsqu\u2019un Client arrive avec une R\u00e9servation. Cela inclut la v\u00e9rification de la preuve de la R\u00e9servation et de l\u2019identit\u00e9 du Client en tant que Client sp\u00e9cifi\u00e9 dans le Contrat de Stockage concern\u00e9. Les clients potentiels qui arrivent sans r\u00e9servation doivent \u00eatre dirig\u00e9s vers le site Web ou l\u2019application Fenua Lockers Chaque H\u00f4te a le droit d\u2019exiger des mesures de s\u00e9curit\u00e9 suppl\u00e9mentaires, telles que l\u2019inspection des bagages stock\u00e9s, l\u2019\u00e9tiquetage des sacs avec les attaches \u00e0 bagages fournies par fenua Lockers et\/ou la photographie des bagages pour enregistrer leur \u00e9tat au moment du Stockage.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">4.2 Chaque h\u00f4te s\u2019efforcera raisonnablement de prot\u00e9ger et de maintenir la s\u00e9curit\u00e9 des articles stock\u00e9s dans son espace de stockage et de veiller \u00e0 ce qu\u2019ils ne soient pas d\u00e9rang\u00e9s. Les h\u00f4tes doivent utiliser l\u2019espace de stockage approuv\u00e9 \u00e0 l\u2019avance par Fenua Lockers pour la prestation d\u2019un stockage s\u00e9curis\u00e9.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">4.3 Si un client ne vient pas chercher son article \u00e0 l\u2019heure indiqu\u00e9e dans sa r\u00e9servation, l\u2019h\u00f4te doit en informer Fenua Lockers. Fenua Lockers tentera de joindre le Client et de prendre des dispositions pour qu\u2019il vienne chercher son article \u00e0 une nouvelle heure. A d\u00e9faut, Fenua Lockers organisera la collecte de l\u2019objet chez l\u2019H\u00f4te et la livraison de l\u2019objet au Client, aux frais de ce dernier. Si le client ne peut \u00eatre contact\u00e9 ou ne parvient pas \u00e0 organiser la collecte et la livraison, Fenua Lockers organisera la collecte de l\u2019article et en disposera sans autre responsabilit\u00e9 envers le client ou l\u2019h\u00f4te.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">4.4<span style=\"margin: 0px; padding: 0px; outline: none; font-weight: bold;\">\u00a0Si un H\u00f4te modifie ses heures d\u2019ouverture (de mani\u00e8re g\u00e9n\u00e9rale ou un jour particulier) et que cela affecte une R\u00e9servation existante, l\u2019H\u00f4te doit en informer d\u2019urgence Fenua Lockers par courrier \u00e9lectronique \u00e0 info@fenualockers.com.<\/span>\u00a0Lorsqu\u2019un H\u00f4te n\u2019est pas ouvert ou qu\u2019il ne re\u00e7oit pas ou ne fournit pas le Stockage en vertu d\u2019un Contrat de Stockage conclu avec cet H\u00f4te (un \u201d H\u00f4te d\u00e9faillant \u201c), la politique de Fenua Lockers est de rembourser les frais de R\u00e9servation pay\u00e9s par le Client et\/ou, lorsque cela est possible et avec l\u2019accord du Client, d\u2019organiser une R\u00e9servation aupr\u00e8s d\u2019un autre H\u00f4te pour le Client. Dans ces cas, l\u2019H\u00f4te d\u00e9faillant ne sera pas en droit de recevoir de Redevance de Stockage sur la R\u00e9servation et, si la Redevance de Stockage a d\u00e9j\u00e0 \u00e9t\u00e9 pay\u00e9e par Fenua Lockers \u00e0 l\u2019H\u00f4te d\u00e9faillant, il sera redevable \u00e0 Fenua Lockers d\u2019un montant \u00e9quivalent \u00e0 la Redevance de Stockage due par Fenua Lockers \u00e0 l\u2019H\u00f4te alternatif, que nous pourrons compenser et d\u00e9duire de la prochaine Redevance de Stockage payable par Fenua Lockers \u00e0 l\u2019H\u00f4te d\u00e9faillant.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">4.5 Chaque Client accepte de ne stocker aucun des articles interdits identifi\u00e9s dans la Condition 4 du Client \u201d Articles interdits \u201c. Si un H\u00f4te soup\u00e7onne raisonnablement une violation de la Condition 4 du Client, l\u2019H\u00f4te a le droit de retirer et d\u2019\u00e9liminer les articles stock\u00e9s sans pr\u00e9avis au Client et sans responsabilit\u00e9 pour le Client. L\u2019H\u00f4te peut \u00e9galement signaler \u00e0 toute autorit\u00e9 comp\u00e9tente toute activit\u00e9 ill\u00e9gale ou suspect\u00e9e du Client ou tout article dangereux stock\u00e9. L\u2019H\u00f4te doit informer Fenua Lockers d\u00e8s qu\u2019il a connaissance d\u2019une violation ou d\u2019une violation pr\u00e9sum\u00e9e de la Condition 4 du Client. En effectuant une r\u00e9servation sur ce site Web ou sur l\u2019application, le client a \u00e9galement accept\u00e9 de lib\u00e9rer et d\u2019indemniser l\u2019h\u00f4te de toute responsabilit\u00e9 li\u00e9e \u00e0 l\u2019enl\u00e8vement et\/ou \u00e0 l\u2019\u00e9limination par l\u2019h\u00f4te des biens stock\u00e9s, ou \u00e0 la violation par le client de la condition 4.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">4.6 Chaque h\u00f4te est responsable de tout dommage, perte ou vol des articles stock\u00e9s chez cet h\u00f4te, \u00e0 moins que le dommage ne soit caus\u00e9 par des facteurs ind\u00e9pendants de la volont\u00e9 de l\u2019h\u00f4te. Chaque client est responsable de toute blessure ou de tout dommage caus\u00e9 \u00e0 l\u2019h\u00f4te, \u00e0 ses biens ou \u00e0 des tiers par les articles stock\u00e9s ou par un acte de n\u00e9gligence ou une omission du client. En tant que prestataire de services interm\u00e9diaires, Fenua Lockers ne sera pas responsable dans les deux cas mentionn\u00e9s ci-dessus et chaque client et h\u00f4te lib\u00e8re Fenua Lockers de toute responsabilit\u00e9 \u00e0 son \u00e9gard.<\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\">5. Paiements<\/h2><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">5.1 Les Clients doivent payer \u00e0 Fenua Lockers (agissant en tant que marchand officiel pour le compte de l\u2019H\u00f4te) un tarif sp\u00e9cifi\u00e9e au Client comme \u00e9tant applicable au stockage devant \u00eatre fourni par l\u2019H\u00f4te (\u201d Redevance de stockage \u201c), y compris toute TVA applicable, lorsqu\u2019ils effectuent une R\u00e9servation sur le Site Internet ou l\u2019application.\u00a0<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">5.2 Le taux de la redevance de stockage qui s\u2019applique \u00e0 chaque r\u00e9servation, et que Fenua Lockers per\u00e7oit pour le compte de l\u2019h\u00f4te et verse \u00e0 l\u2019h\u00f4te, d\u00e9duction faite de la commission (TVA incluse), sera celui convenu de temps \u00e0 autre entre chaque h\u00f4te et Fenua Lockers.\u00a0<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">5.3 Le taux de la commission payable par l\u2019h\u00f4te doit \u00eatre convenu par l\u2019h\u00f4te par \u00e9crit avec nous avant l\u2019approbation de la cr\u00e9ation d\u2019une inscription (tel que modifi\u00e9 de temps \u00e0 autre par \u00e9crit).<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">5.4 A la r\u00e9ception du montant de la Redevance de Stockage, Fenua Lockers d\u00e9duit sa Commission et verse ensuite la Redevance de Stockage nette \u00e0 l\u2019H\u00f4te par virement bancaire sur les coordonn\u00e9es indiqu\u00e9es par l\u2019H\u00f4te, mensuellement \u00e0 terme \u00e9chu, le ou vers le 10\u00e8me jour du mois suivant le mois au cours duquel le Stockage concern\u00e9 a \u00e9t\u00e9 fourni.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">5.5 Dans le cadre de l\u2019accord de repr\u00e9sentation vis\u00e9 \u00e0 l\u2019article 1, Fenua Lockers a la comp\u00e9tence pour offrir des remises promotionnelles sur les frais de stockage pour toute r\u00e9servation du Client, comme elle le juge bon.<\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\">6.Taxes<\/h2><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">Chaque h\u00f4te comprend et accepte qu\u2019il est seul responsable de la d\u00e9termination de ses exigences en mati\u00e8re de comptabilit\u00e9 et de d\u00e9claration fiscale (y compris, mais sans s\u2019y limiter, la taxe sur la valeur ajout\u00e9e) en consultation avec ses conseillers fiscaux, si cela est jug\u00e9 appropri\u00e9. fenua Lockers ne peut pas offrir et n\u2019offre pas de conseils fiscaux \u00e0 un h\u00f4te.<\/p><h2 style=\"margin: 0px 0px 20px; padding: 0px; outline: none; font-family: Quicksand, sans-serif; font-weight: bold; line-height: 30px; color: #7a7a7a; font-size: 18px;\">7. Cela inclut la notification que, \u00e0 la fin de l\u2019Accord, les donn\u00e9es personnelles les concernant peuvent \u00eatre conserv\u00e9es ou, selon le cas, transf\u00e9r\u00e9es \u00e0 un ou plusieurs des Destinataires Autoris\u00e9s, leurs successeurs et cessionnaires ;<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">(c) traiter les Donn\u00e9es personnelles partag\u00e9es uniquement aux fins convenues ;<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">(d) ne pas divulguer ou permettre l\u2019acc\u00e8s aux Donn\u00e9es Personnelles Partag\u00e9es \u00e0 toute personne autre que les Destinataires Autoris\u00e9s ;<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">(e) s\u2019assurer que tous les Destinataires Autoris\u00e9s sont soumis \u00e0 des obligations contractuelles \u00e9crites concernant les Donn\u00e9es Personnelles Partag\u00e9es (y compris des obligations de confidentialit\u00e9) qui ne sont pas moins on\u00e9reuses que celles impos\u00e9es par cet accord ;<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">(f) s\u2019assurer qu\u2019elle a mis en place des Mesures de protection.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">(g) ne pas transf\u00e9rer les donn\u00e9es personnelles re\u00e7ues du Donneur de Donn\u00e9es en dehors de l\u2019EEE, \u00e0 moins que le c\u00e9dant :<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">(i) respecte les dispositions des articles 26 du GDPR (dans le cas o\u00f9 le tiers est un contr\u00f4leur conjoint) ; et<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">(ii) s\u2019assure que le transfert se fait vers un pays approuv\u00e9 par la Commission europ\u00e9enne comme offrant une protection ad\u00e9quate conform\u00e9ment \u00e0 l\u2019article 45 du GDPR ;(ii) des garanties appropri\u00e9es sont en place conform\u00e9ment \u00e0 l\u2019article 46 GDPR ; ou (iii) l\u2019une des d\u00e9rogations pour des situations sp\u00e9cifiques de l\u2019article 49 GDPR s\u2019applique au transfert.<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">3.2. Chaque partie aide l\u2019autre \u00e0 se conformer \u00e0 toutes les exigences applicables de la l\u00e9gislation sur la protection des donn\u00e9es. En particulier, chaque partie doit :<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">(a) consulter l\u2019autre partie au sujet de tout avis donn\u00e9 aux Personnes concern\u00e9es en relation avec les Donn\u00e9es personnelles partag\u00e9es ;<\/p><p style=\"margin-bottom: 20px; padding: 0px; outline: none; font-size: 14px;\">(b) informer rapidement l\u2019autre partie de la r\u00e9ception de toute demande de droits des personnes concern\u00e9es ;<\/p><p style=\"margin-bottom: 20px;
